The concept of ethical sourcing has risen in popularity during the past four years.\u201d\u00a0\u00a0<\/span><\/p>\n<p><a target=\"_blank\" href=\"https:\/\/www.precisionsoftware.com\/resources\/blog\/-\/blogs\/new-regulations-the-challenge-of-supply-chain-due-diligence\" rel=\"noopener\"><span style=\"font-weight: 400;\">Supply chain due diligence<\/span><\/a><span style=\"font-weight: 400;\"> is a critical topic for manufacturers and enterprises in all industries, especially given three major impacts of recent high-profile abuse cases, new due diligence laws and consumer buying trends.\u00a0\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Let\u2019s break it down.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Recent High Profile Cases<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">It doesn\u2019t take a very deep search to uncover recent global headlines of abuses in production.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In April 2022, allegations arose claiming<\/span><a target=\"_blank\" href=\"https:\/\/www.birminghammail.co.uk\/news\/midlands-news\/cadbury-issues-statement-after-channel-23586129\" rel=\"noopener\"> <span style=\"font-weight: 400;\">children as young as 10 in Ghana<\/span><\/a><span style=\"font-weight: 400;\">, West Africa were harvesting cocoa beans for food industry giant Mondel\u0113z International, which owns Cadbury. The company issued this statement at the time: <\/span><span style=\"font-weight: 400;\">&#8220;We explicitly prohibit child labour in our operations and have been working relentlessly to take a stand against this.&#8221;\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In Bangladesh in July 2021,<\/span><a target=\"_blank\" href=\"https:\/\/www.bbc.com\/news\/world-asia-57790294\" rel=\"noopener\"> <span style=\"font-weight: 400;\">a fire at a food factory<\/span><\/a><span style=\"font-weight: 400;\"> claimed the lives of at least 52 people, some of whom were children.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In the U.S., as a tornado struck a town in Kentucky in December 2021, workers at<\/span><\/p>\n<p><a target=\"_blank\" href=\"https:\/\/www.republicworld.com\/world-news\/us-news\/kentucky-candle-factory-deaths-why-workers-kept-working-during-tornado-know-more.html\" rel=\"noopener\"><span style=\"font-weight: 400;\">Mayfield Consumer Product factory<\/span><\/a><span style=\"font-weight: 400;\"> continued making candles as the massive storm bore down on the region, even after receiving a notification 20 minutes before the tornado hit.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In April 2021, food giant Hershey <\/span><span style=\"font-weight: 400;\">Food announced its \u201c<\/span><a target=\"_blank\" href=\"https:\/\/www.scdigest.com\/ONTARGET\/21-04-14_HERSHEY_SUSTAINABILITY_RULES_SUPPLIERS.PHP?cid=18589&amp;ctype=content\" rel=\"noopener\"><span style=\"font-weight: 400;\">No Deforestation Policy<\/span><\/a><span style=\"font-weight: 400;\">\u201d to end deforestation across its supply chain by 2030. However, earlier in the year Hershey was named in a lawsuit regarding child labor abuses in Cote D\u2019Ivoire.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Two<\/span><a target=\"_blank\" href=\"https:\/\/www.supplychaindive.com\/news\/Foxconn-China-Apple-deaths-ethical-supply-chain\/425008\/\" rel=\"noopener\"> <span style=\"font-weight: 400;\">Foxconn Technology workers<\/span><\/a><span style=\"font-weight: 400;\"> died in 2016 in work-related incidents at the company\u2019s Zhengzhou, China plant, which produces Apple iPhones. Despite this, Apple claims its suppliers uphold fair labor and human rights standards. However, Foxconn has faced repeated scrutiny for labor-related deaths.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">New Due Diligence Laws<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Manufacturers across the globe are facing<\/span><a target=\"_blank\" href=\"https:\/\/www.precisionsoftware.com\/resources\/blog\/-\/blogs\/new-regulations-the-challenge-of-supply-chain-due-diligence\" rel=\"noopener\"> <span style=\"font-weight: 400;\">new due diligence laws<\/span><\/a><span style=\"font-weight: 400;\"> in addition to historical legislation relating to human rights and environmental protection. These new laws are pushing for greater CSR accountability for corporations and their supply chains and levying penalties for non-compliance.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For example, new laws have been or will soon be enacted <\/span><span style=\"font-weight: 400;\">in the U.S. and across Europe. The legislation generally<\/span> <span style=\"font-weight: 400;\">seeks to implement the standards set by the U.N. Guiding Principles on Business and Human Rights to eliminate forced and child labor, add environmental protections, eradicate human rights abuses, and seek to improve working conditions.\u00a0\u00a0\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">United States<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The <\/span><a target=\"_blank\" href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/65?s=1&amp;r=88#:~:text=Passed%20Senate%20(07%2F14%2F2021),-Uyghur%20Forced%20Labor&amp;text=This%20bill%20imposes%20importation%20limits,related%20to%20such%20forced%20labor.\" rel=\"noopener\"><span style=\"font-weight: 400;\">Uyghur Forced Labor Prevention Act (UFLPA)<\/span><\/a><span style=\"font-weight: 400;\"> states all goods fully or partially manufactured in China&#8217;s Xinjiang Uyghur Autonomous Region are products of forced labor and are not eligible for U.S. entry.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Europe<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The<\/span><a target=\"_blank\" href=\"https:\/\/www.business-humanrights.org\/en\/latest-news\/german-due-diligence-law\/\" rel=\"noopener\"> <span style=\"font-weight: 400;\">German Supply Chain Act (GSCA)<\/span><\/a><span style=\"font-weight: 400;\"> goes into effect January 1, 2023 for companies with 3,000 or more employees and will extend to companies with 1,000 or more employees January 1, 2024. The legislation is not restricted to German companies alone \u2014 foreign-based companies with registered German branches must also comply.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><span style=\"font-weight: 400;\">European Union released the Mandatory Human Rights and Environmental Due Diligence Directive earlier this year.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The European Commission published the proposal for a<\/span><a target=\"_blank\" href=\"https:\/\/www.business-humanrights.org\/en\/latest-news\/eu-commissioner-for-justice-commits-to-legislation-on-mandatory-due-diligence-for-companies\/\" rel=\"noopener\"> <span style=\"font-weight: 400;\">Corporate Sustainability Due Diligence<\/span><\/a><span style=\"font-weight: 400;\"> draft directive in February 2022.<\/span><\/p>\n<p>Norway, Switzerland, the Netherlands, France, and the UK have all passed similar legislation.<\/p>\n<p><span style=\"font-weight: 400;\">Greater accountability standards around CSR and accompanying consequences add further challenges to the already complicated international trade compliance landscape. Enterprises must focus on due diligence legislation to compete successfully in the global market. Ignoring the legislation could lead to monetary penalties, bad PR, and a drop in consumer trust \u2013 not to mention the potential loss of source materials and the possibility of production interruptions.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Consumer Buying Trends<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Consumers are increasingly expressing interest in ethical sourcing and environmental impacts related to the products they purchase.<\/span><\/p>\n<p><a target=\"_blank\" href=\"https:\/\/www2.deloitte.com\/uk\/en\/pages\/consumer-business\/articles\/sustainable-consumer.html\" rel=\"noopener\"><span style=\"font-weight: 400;\">A 2021 Deloitte study<\/span><\/a> <span style=\"font-weight: 400;\">documented how 43% of UK consumers selected brands based on environmentally sustainable values. The same study indicated that 34% stopped buying brands with ethics concerns. A similar study in the U.S. found that consumers would stop purchasing brands with ethics issues. When demographics are added, research finds that millennials and younger age groups place a distinct priority on sustainability.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">During a time where workforce retention has proven to be especially difficult, serving as a company with a strong CSR policy can actually help to attract and retain top talent. According to an <\/span><a target=\"_blank\" href=\"https:\/\/www.forbes.com\/sites\/afdhelaziz\/2020\/03\/07\/the-power-of-purpose-the-business-case-for-purpose-all-the-data-you-were-looking-for-pt-2\/?sh=5f1413c3cf7a\" rel=\"noopener\"><span style=\"font-weight: 400;\">article<\/span><\/a><span style=\"font-weight: 400;\"> in <\/span><i><span style=\"font-weight: 400;\">Forbes<\/span><\/i><span style=\"font-weight: 400;\">, \u201c64% of Millennials won\u2019t take a job if their employee doesn\u2019t have a strong CSR policy.\u201d And, after looking at the numerous ways purpose has driven success with consumers, \u201cpurpose-driven companies had 40% higher levels of workforce retention than their competitors.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Companies are acting, and responding.<\/span><a target=\"_blank\" href=\"https:\/\/home.kpmg\/xx\/en\/home\/insights\/2020\/11\/the-time-has-come-survey-of-sustainability-reporting.html\" rel=\"noopener\"> <span style=\"font-weight: 400;\">A 2020 KPMG analysis<\/span><\/a> <span style=\"font-weight: 400;\">found that:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">96% of the world\u2019s biggest 250 companies produce an annual sustainability report<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">All top 100 companies in Japan and Mexico produce an annual sustainability report<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">80% of all companies worldwide report their sustainability performance<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Consumers are making buying decisions based on ethical issues \u2013 consumer trends indicate that shoppers favor companies acting on corporate social responsibility and environmental\/social\/governance issues. Business-to-business buyers are likewise focusing more on corporate social responsibility and environmental\/social\/governance challenges over costs and service levels. Producers need<\/span><a target=\"_blank\" href=\"https:\/\/www.qad.com\/solutions\/integrated-supplier-management\" rel=\"noopener\"><span style=\"font-weight: 400;\"> supplier management software<\/span><\/a><span style=\"font-weight: 400;\"> to qualify suppliers and automated ways to conduct<\/span><a target=\"_blank\" href=\"https:\/\/www.qad.com\/solutions\/restricted-party-screening\" rel=\"noopener\"> <span style=\"font-weight: 400;\">restricted party screening<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A recent article from the<\/span><a target=\"_blank\" href=\"https:\/\/www.ama.org\/marketing-news\/does-the-world-really-need-more-brands\/\" rel=\"noopener\"> <span style=\"font-weight: 400;\">American Marketing Association<\/span><\/a> <span style=\"font-weight: 400;\">sums it up well:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cOld metrics, models and assumptions may be our own worst enemy in a market where consumer demands have shifted to value trust over newness, lasting quality over flashy features, and humancentric purpose over hype.
