{"id":11759,"date":"2024-03-28T08:47:49","date_gmt":"2024-03-28T15:47:49","guid":{"rendered":"https:\/\/www.qad.com\/blog\/?p=11759"},"modified":"2024-04-01T10:01:23","modified_gmt":"2024-04-01T17:01:23","slug":"uflpa-non-compliance-is-not-an-option","status":"publish","type":"post","link":"https:\/\/www.qad.com\/blog\/2024\/03\/uflpa-non-compliance-is-not-an-option","title":{"rendered":"UFLPA: Non-Compliance is Not an Option"},"content":{"rendered":"<p>[vc_row][vc_column][vc_single_image image=&#8221;11760&#8243; img_size=&#8221;full&#8221;][vc_column_text]<span style=\"font-weight: 400;\">News broke this February that customs officials in the United States had confiscated thousands of <\/span><a target=\"_blank\" href=\"https:\/\/www.euronews.com\/business\/2024\/02\/15\/european-car-imports-held-up-in-us-over-banned-chinese-part\" rel=\"noopener\"><span style=\"font-weight: 400;\">cars made by Volkswagen<\/span><\/a><span style=\"font-weight: 400;\">. The VW brands impacted included Porsche, Bentley and Audi. Authorities claimed that the cars included parts made with forced labor in China&#8217;s Xinjiang region.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The US, along with other nations, has accused China of human rights abuses, including forced labor in Xinjiang Uygur Autonomous Region (XUAR). To counter this, the US government enacted Uyghur Forced Labor Prevention Act (UFLPA) to prohibit the importation of goods that are suspected of being made by forced labor.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">VW is certainly not the first major automaker to fall afoul of the UFLPA. In 2022, <\/span><a target=\"_blank\" href=\"https:\/\/www.businessinsider.com\/companies-brands-china-supply-chains-illegal-forced-labor-2022-12?r=US&amp;IR=T\" rel=\"noopener\"><span style=\"font-weight: 400;\">a report from Sheffield Hallam University<\/span><\/a><span style=\"font-weight: 400;\"> found that every large car manufacturer was at a high risk of sourcing parts linked to Xinjiang. Nor do automotive companies exclusively face this problem. It impacts many other industries, such as consumer electronics and clothing.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">CBP Seizures<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">President Biden signed the UFLPA into law on December 23, 2021. It has been in force since June 21, 2022. US Customs and Border Protection (CBP) has significant powers under this law. CBP can seize any imported goods suspected of being made, wholly or in part, with forced labor in Xinjiang.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">By February 2024, CBP had issued Withhold Release Orders (WROs) on over <\/span><a target=\"_blank\" href=\"https:\/\/www.cbp.gov\/newsroom\/stats\/trade\/uyghur-forced-labor-prevention-act-statistics\" rel=\"noopener\"><span style=\"font-weight: 400;\">7,000 shipments worth $2.6B<\/span><\/a><span style=\"font-weight: 400;\">. The most frequent products suspected of being in violation of the law include:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Electronics<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Apparel, footwear and textiles<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Industrial and manufacturing materials<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Agriculture and prepared products<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Consumer products and mass merchandising<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">To have their goods returned, companies must be able to prove that they have not violated the law.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, if your company does not import from China, it does not mean that you are in compliance with the law. <\/span><a target=\"_blank\" href=\"https:\/\/www.qad.com\/blog\/2023\/08\/your-uflpa-risks-may-be-wearing-a-disguise\" rel=\"noopener\"><span style=\"font-weight: 400;\">Your UFLPA risks may be wearing a disguise<\/span><\/a><span style=\"font-weight: 400;\">. CBP has stopped more shipments from Malaysia and Vietnam than from China itself.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">How are Companies Reacting?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Many companies have been slow to react to new laws and regulations like the UFLPA, and the German Supply Chain Due Diligence Act.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The challenge for many companies is this: they don\u2019t know who all of their upstream suppliers are.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This is due to the complexities of global supply chains. Many enterprises have no visibility beyond Tier 1 suppliers. As a result, issues like forced labor and environmental impact are hard to identify and measure.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nonetheless, the complexity of compliance requirements is not an excuse. Companies dependent on global trade must adhere to all import and export regulations \u2014 including the UFLPA.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Furthermore, a head in the sand approach is becoming untenable. Companies face ever greater accountability across their supply chains.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">There has also been a profound shift in the culture around corporate social responsibility. Goods made with forced labor are simply not acceptable. Consumers increasingly expect companies to adhere to <\/span><a target=\"_blank\" href=\"https:\/\/www.qad.com\/blog\/2023\/05\/how-to-navigate-esg-risk-with-supplier-management-software\" rel=\"noopener\"><span style=\"font-weight: 400;\">Environmental, Social and Governance<\/span><\/a><span style=\"font-weight: 400;\"> (ESG) mandates.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In addition, new regulations will keep coming, such as the European Union\u2019s Corporate Sustainability Due Diligence Directive (CSDDD). Companies will find it increasingly difficult to ignore human rights abuses and other issues in the supply chain.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Supplier Transparency<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Some industries have better knowledge about their supply chain, so they can handle due diligence better. But overall, new rules are making companies confront the risks of lack of supplier transparency. Many realize that they are not prepared enough. Oftentimes, they are reactive when problems arise, instead of planning ahead for new legislation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, a combination of consumer sentiment and regulatory pressures, in the form of fines and confiscated goods, will force companies to be more proactive.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This means understanding who your trade partners and suppliers are. It also means knowing who their suppliers are in turn. If, or when, you uncover concerns about your suppliers, you will need to take action.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This could include disruptive actions such as ditching suppliers and\/or changing sourcing strategies. Using a single supplier for critical parts is more than just a risk. It could be an existential threat to a company.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The good news for large enterprises is that they have significant leverage over suppliers. Therefore, greater collaboration and <\/span><a target=\"_blank\" href=\"https:\/\/www.qad.com\/blog\/2023\/06\/defining-supplier-development\" rel=\"noopener\"><span style=\"font-weight: 400;\">supplier development<\/span><\/a><span style=\"font-weight: 400;\"> may be a better response.
